1. Acceptance of Terms
By accessing or using the Home Trade Pros website at hometradepros.com (the "Platform"), operated by Home Trade Pros LLC ("Home Trade Pros," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.
2. Description of Service
Home Trade Pros is an online marketplace that connects homeowners seeking home improvement and repair services ("Homeowners") with licensed contractors ("Contractors"). We provide a platform for Homeowners to submit project requests and for Contractors to purchase leads containing Homeowner contact information and project details.
Home Trade Pros is a lead generation platform only. We are not a contractor, general contractor, construction company, or home services provider. We do not perform, supervise, direct, or control any work done by Contractors. We are not a party to any agreement between Homeowners and Contractors. Contractors are independent businesses and are not employees, agents, partners, or representatives of Home Trade Pros. Home Trade Pros does not employ contractors or control how contractors perform their work. Home Trade Pros does not mediate disputes between Homeowners and Contractors and is not responsible for resolving disagreements related to services, payments, or work quality.
3. Eligibility
You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
4. Homeowner Terms
By submitting a project on the Platform, you agree that:
- All information you provide is accurate and truthful
- You are the property owner or are authorized by the property owner to request services
- Your phone number will be verified via SMS before your project is submitted
- Your contact information and project details will be shared with up to 3 licensed contractors who purchase your lead
- You may be contacted by those contractors via your preferred contact method
- Submitting a project does not create an obligation to hire any contractor
- You are responsible for independently evaluating and selecting any contractor you choose to hire
- You may only submit one open project per trade at a time
5. Contractor Terms
By registering as a Contractor on the Platform, you represent and agree that:
- You hold a valid, active contractor license issued by the California State Licensing Board (CSLB) or the applicable state licensing authority
- You are the individual or authorized representative of the business to which the license was issued
- All information provided during registration is accurate and current
- You consent to identity verification, which may include an automated phone call to the phone number on file with the CSLB and/or submission of a government-issued photo ID
- You will maintain all required licenses, bonds, and insurance as mandated by state and local law. Contractors are solely responsible for maintaining these credentials and for ensuring compliance with all applicable laws and regulations.
- You will not misrepresent your qualifications, experience, or licensing status
- You are solely responsible for all work performed, including quality, safety, and compliance with applicable building codes and regulations
- Homeowner contact information obtained through the Platform will only be used for the purpose of providing services related to the submitted project
6. License Verification
We verify contractor licenses through the California State Licensing Board (CSLB) and conduct identity verification to help prevent unauthorized use of license information. However, verification confirms only that a license number is valid and that the registering individual has demonstrated control of the associated CSLB phone number or provided valid identification.
License verification does not constitute an endorsement, recommendation, or guarantee of any contractor's work quality, reliability, safety practices, financial stability, or fitness for any particular job. Homeowners should independently verify contractor credentials, insurance, references, and qualifications before hiring.
7. Payments and Pricing
Lead Purchases
- Contractors purchase leads at the price displayed at the time of purchase
- Prices are determined by trade, job type, and current market conditions (supply and demand)
- Standard leads may be purchased by up to 3 contractors; exclusive leads are available to 1 contractor at a premium price
- All prices are shown before purchase — there are no hidden fees
- Leads expire after 7 days if not purchased
- Home Trade Pros does not guarantee the accuracy, completeness, or legitimacy of any project submission and makes no representation that any lead will result in a hired job
Wallet and Credits
- Contractors may prepay for credits through our wallet system
- Credit purchases include a 30% bonus (e.g., a $100 purchase receives $130 in credits)
- Credits do not expire
- Credits are non-transferable and non-refundable except as described in the Credit-Back Policy. Wallet credits have no cash value and cannot be redeemed for cash
Payment Processing
All payments are processed securely through Stripe. We do not store credit card information on our servers. By making a purchase, you agree to Stripe's Terms of Service and Privacy Policy.
8. Credit-Back Policy
We offer a credit-back policy for leads that do not meet quality standards. Contractors may request a credit-back for the following reasons:
- Wrong or disconnected phone number
- Fake or fraudulent submission
- Job was already completed
- Duplicate lead
- Incorrect trade category
All credit-back requests are subject to review and approval by Home Trade Pros. Approved credit-backs are returned as wallet credits equal to the original purchase price. Credit-backs are not issued as cash refunds. We reserve the right to deny credit-back requests that we determine to be fraudulent or otherwise not qualifying.
9. SMS Messaging Terms
Home Trade Pros Notifications
- Home Trade Pros sends transactional SMS messages to users who provide a phone number on the Platform. These messages include phone verification codes, lead purchase notifications, project status updates, account security alerts, and two-factor authentication codes. We do not send marketing or promotional messages.
- You can cancel the SMS service at any time. Just text "STOP" to us. After you send the SMS message "STOP", we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
- If you are experiencing issues with the messaging program, you can reply with the keyword "HELP" for more assistance, or you can get help directly at support@hometradepros.com.
- Carriers are not liable for delayed or undelivered messages.
- As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on your activity (verification codes, lead notifications, project updates, and security alerts). If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

10. Prohibited Conduct
You agree not to:
- Provide false, misleading, or fraudulent information
- Register using another person's contractor license or identity
- Submit fake or spam project requests
- Use Homeowner contact information for purposes unrelated to the submitted project
- Sell, share, or redistribute lead information obtained through the Platform
- Attempt to circumvent payment systems, verification processes, or Platform security
- Harass, threaten, or abuse any user of the Platform
- Use the Platform for any unlawful purpose
- Interfere with or disrupt the Platform or its infrastructure
- Scrape, crawl, or extract data from the Platform without written permission
Violation of these rules may result in immediate account suspension or termination, forfeiture of wallet credits, and potential legal action.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Home Trade Pros is not responsible or liable for the conduct, actions, omissions, quality of work, or any damages caused by any Contractor or Homeowner, whether on or off the Platform.
- We do not guarantee that any Contractor will be available, responsive, qualified for a particular job, properly insured, or that any work performed will be satisfactory, completed on time, or in compliance with applicable codes and regulations.
- We do not guarantee that project submissions are legitimate, that Homeowners will hire a Contractor, or that any lead will result in a paying job.
- Home Trade Pros shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including but not limited to property damage, personal injury, lost profits, or loss of data.
- Our total aggregate liability to you for any claims arising from or related to the Platform shall not exceed the amount you have paid to Home Trade Pros in the twelve (12) months preceding the claim.
12. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE MAY MODIFY, SUSPEND, OR DISCONTINUE THE PLATFORM AT ANY TIME WITHOUT LIABILITY.
13. Indemnification
You agree to indemnify, defend, and hold harmless Home Trade Pros LLC, its officers, members, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Platform
- Your violation of these Terms
- Any work performed or services provided by a Contractor to a Homeowner
- Any dispute between a Homeowner and a Contractor
- Your violation of any law or the rights of any third party
14. Dispute Resolution
Any dispute arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved informally, it shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of California. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
16. Account Termination
We reserve the right to suspend or terminate any account at our sole discretion, with or without notice, including without limitation for suspected fraud, abuse, or violation of these Terms, or for conduct that is harmful to other users or otherwise objectionable. Upon termination:
- Access to the Platform will be revoked
- Unused wallet credits may be forfeited in cases of fraud or Terms violations
- We may retain your data as required by law or as necessary for legitimate business purposes
17. Modifications to Terms
We may update these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Platform after any changes constitutes acceptance of the new Terms. For material changes, we will make reasonable efforts to notify registered users via email.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will remain in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Home Trade Pros regarding your use of the Platform and supersede any prior agreements.
